The site (everyscience.com), any functionality on the site, or anything pertaining to the site, or any subsidiary, affiliate, officer, employee or product of the site, shall hereon be referreed to as the “service”. everyscience.com’s service is subject to the following Terms Of Service (hereon known as “TOS”), which we may update without advising you. Any stated regulations on any part of the service for any particular function are also included in the TOS now by reference. everyscience.com cannot be and is not liable from any loss or damage due to your failure to comply with the entirety of the TOS.
Service Description
everyscience.com offers you an online multimedia textbook for higher education science students and workers, specifically, consisting of one hundred and sixteen pages freely available and two hundred and thirty pages for which a user must subscribe. You understand and agree that part of the service may involve communications from everyscience.com, for example including but not limited to, service announcements, newsletters or administrative messages and you understand and agree that some of these communications you may not opt out of. All current service features and any further new or as yet unreleased service features are also subject to these TOS. You understand and agree that this is an ‘as-is’ service and consequently everyscience.com holds no responsibility for the speed, deletion, mis-delivery, service failure or failure to store any user communications or personalised settings. You agree and understand that you are responsible for providing any equipment required to access and display the site (for example but not limited to a computer and monitor) and also for connecting to the site via the internet, which may include airtime or ISP fees. The service is for higher education students and workers, and as such you agree that you are over the age of 13. You understand and agree the site may only be viewed from the host everyscience.com, that downloading the site (by any means) is expressly prohibited and that everyscience.com has the right to deny your access to the site for and after any attempt to download the site. Specifically you agree not to reproduce, duplicate, copy, sell, resell or exploit for any purposes any portion of the service, use of the service, or access to the service. We may advise you of notices via either email or other communication. We may also provide notification of alterations to the TOS or service itself via notices or links to notices on the site.
Registration
The details you provide us with you agree are accurate and current (known as ‘personal data’), and you agree to update any personal data as necessary to keep the data accurate and current. You agree and understand that any failure to do so, or if everyscience.com has grounds to believe you are failing to do so, it may withdraw your access to the site.
Member Account Security
You agree and understand that your password to the site (if applicable) remains the data and property of everyscience.com, and as such it is forbidden to share this password with anyone else, and that if you have, or everyscience.com has grounds to believe that you have, may withdraw your access to the site. You agree to notify everyscience.com immediately in the event of unauthorised access to your account, or any other breach of security. You agree to logout of your account at the end of every session.
Privacy Policy
We do not disclose any personal information to any subsidiary or third party organisation. We only collect personal data you volunteer, and only for the purposes of authenticating users, technical administration, research and development and customer administration. Our policy complies with the EU Data Directive, the FTC Act (USA) and the Data Protection Act 1998 (UK). We are a registered Data Controller with Government. Member Conduct
You understand that any material you submit, or is submitted from your account, to and is displayed on the site is your sole responsibility. Consequently everyscience.com is not liable for any loss or damages arising from the material. everyscience.com does not monitor material submitted, and as such some material may be inaccurate, furthermore some of it may be objectionable, and that under all circumstances everyscience.com is not liable for errors in the material, loss or damages arising from the material. You agree to not submit material that is or may (1) be unlawful, abusive, harmful, libellous, harassing or otherwise objectionable to any group of people. (2) infringe any propriety rights (3) computer code (4) be restricted legally or by client or employment relationships (5) be indecent (6) advertising, promotional material or any other form of invitation to a service or product. (7) impersonate someone else, either my feigning headers disguising the origin of the material, or by using another’s account, or any other means to impersonate someone other than yourself. (8) collect or store another users personal data. You agree and understand that whilst everyscience.com doesn’t monitor the material submitted, everyscience.com has the option to remove any material at their sole discretion. You agree and understand that the processing of any material submitted may travel over various global networks and is not restricted to the region of origin.
Refund Policy
Whilst every effort will be made to ensure your satisfaction, should you still be dissatisfied, refunds will only be given at the discretion of the Everyscience.com and a reason may be required.
Submitted Material License
everyscience.com doesn’t take ownership of any material submitted to the service, however, you understand and agree that everyscience.com has a world-wide and royalty exempt license to use, copy, distribute, alter, publicly perform and display the material.
Indemnity
You understand and agree to remain liable for any claim arising from the material submitted from your account and so indemnify everyscience.com, its subsidiaries, affiliates, officers and employees from such a claim.
General Service, Alterations to it and Cessation
You understand and agree that everyscience.com retains the right to operate all services as it wishes, including but not limited to, maximum material submitted or transmitted, maximum material stored, maximum days material retained, maximum number of times the service may be accessed with a given period of time, etc. You acknowledge that everyscience.com is not liable for any deleted or damaged material (submitted, stored or otherwise). You agree that everyscience.com has your permission to alter these operational practises, without discussion or argument, with or without notice, either generally or to a specific user, including but not limited to, the permanent or temporary cessation of any service, and that everyscience.com is not liable to anyone for any service alteration or cessation.
3rd Party Dealings
You understand and agree that any communication or transaction of any kind with any 3rd party found on, with or through our services, included but not limited to, payments, deliveries and warranties, are absolutely between you and the 3rd party. Further, you agree that everyscience.com is neither responsible nor liable for any loss or damage arising from these communications or transactions.

You understand and agree that all material, except material submitted by users, is the property of everyscience.com and is protected by applicable intellectual property and other laws. everyscience.com grants you a personal, non-transferable and non-exclusive license to view this material, provided that you do not copy, distribute, create a derivative work, publicly display or perform the material, or permit anyone else to. You understand and agree not to access the material by any means other than that provided by everyscience.com.
Disclaimer and Liability Limitation
You understand and agree that (1) your use of the service is solely at your own risk (2) any communication from everyscience.com, oral or otherwise, shall not create any warranty, whether implied or not. (3) everyscience.com makes no guarantee that the service will meet your needs, will be uninterrupted, timely, secure or bug-free, that the material, or results derived from, shall be accurate or reliable and that errors and emissions will be corrected. You understand and agree that everyscience.com shall not liable for any kind of damages, including and not limited to, examination marks, intellectual knowledge, loss of profits or other tangible or intangible losses (even if everyscience.com has been advised about potential losses) resulting from (1) the utilisation or inability to utilise the service, (2) unauthorised access to, and or modification of, your data (3) material submitted by a 3rd party (4) any other matter relating to the service. It is noted that in some places the exclusion of certain warranties and the limitation of liability for consequential or incidental damages is forbidden, hence, you may be exempt from some of the above.
TOS Agreement
These TOS are the sum total of the agreement between you and everyscience.com, and by using the service you agree to them. They supercede any previous arrangements made between yourself and everyscience.com. This agreement shall be governed by the laws of the United Kingdom (UK), accordingly, you and everyscience.com understand and agree to submit to the jurisdiction of the courts of the UK. In the event that everyscience.com fails to exercise or enforce a right or provision of any part of the TOS, this does not render the right or provision invalid. You understand and agree that any claim resulting from the service must be filed within twelve (12) months of the cause of the claim, or barred forever.
